Terms of Use

The deal between us, in plain English.

These Terms of Use are a binding agreement between you and ByTheWay Enterprise, LLC, the company behind By The Way (“By The Way,” “we,” “us”). They cover every By The Way app — Daily Us, Practiced, Steward, Calling, Avi, Ima, and Artios — on the web and on mobile. We wrote them to be read, not skimmed past. If anything here is unclear, write hello@bytheway.biz and a real human will answer.

Accepting these terms

You accept these Terms when you check the acceptance box during onboarding, and again each time you keep using the apps after accepting. If you don't agree with them, don't use the apps — that's the honest trade.

You must be at least 18 years old and able to form a binding contract to create an account. The apps are built for adults; where an app touches your family (like Avi and Ima), the account holder is the parent, not the child.

Your account

Sign-in uses your email address, so keep that inbox secure — anyone who controls your email can reach your account. Give us accurate information, keep it current (you can change your email from account settings; both addresses have to confirm before anything switches), and don't share your account or impersonate someone else. You're responsible for activity that happens under your account.

Subscriptions, trials, and billing

Each app comes with a 7-day free trial that starts the first time you open that app — no card required. When the trial ends, you need a subscription to keep using that app. Daily Us is $19.99/month per couple; each app and bundle shows its current price before you subscribe.

Billing happens on the web through Stripe, our payment processor. Subscriptions renew automatically each billing period until you cancel. You can cancel any time from inside the app; cancellation takes effect at the end of your current billing period, and you keep access until then. We don't issue partial-period refunds except where the law requires it.

Your data doesn't vanish when a trial or subscription lapses. It stays in place, and subscribing later unlocks it again. If we change a price, we'll tell you before it applies to you — no silent increases.

The mobile apps

The mobile apps don't sell anything. There are no purchases, prices, or payment buttons in them — they simply read the subscription status attached to your account. Everything you buy, you buy on the web. Your writing, check-ins, and progress sync between web and mobile because it's all one account.

Acceptable use

Use the apps for what they're built for — practicing your marriage, family, faith, work, and finances. Don't use them to harass, threaten, or harm anyone; don't upload content that's unlawful or infringes someone else's rights; don't scrape data, probe or attack the infrastructure, reverse-engineer the service, resell access, or use automated tools to bulk-extract content. We may suspend or terminate accounts that break these rules.

Your content is yours

Everything you write inside the apps — Weekly Sync entries, Annual Review reflections, journal entries, assessment answers, letters to your kids, all of it — belongs to you. We claim no ownership. We don't train AI models on it, and we don't use it for marketing.

So the service can actually work, you give us a limited, non-exclusive license to store, process, transmit, back up, and display your content — only as needed to operate, secure, and improve the service for you. That license ends when you delete the content or your account, except for backup copies that age out on their normal schedule. Where an app is built for sharing — like Daily Us syncs between you and your spouse — your content is shared exactly the way the app describes, and no further.

AI-generated content

Some features use AI to generate readings, summaries, coaching prompts, and reflections from what you share. AI output can be imperfect — it may miss context, oversimplify, or occasionally get something wrong. Treat it as a starting point for your own thinking, not an authority. Use your judgment, and for anything consequential, verify before you act.

Not professional advice

By The Way apps — Daily Us, Practiced, Steward, Calling, Avi, Ima, and Artios — provide general education, reflection prompts, and relationship, parenting, financial, career, spiritual, and wellness practice tools. They are not professional services and are not a substitute for professional, medical, legal, financial, or therapeutic advice from a licensed therapist, counselor, physician, attorney, financial advisor, or member of the clergy. Nothing in the apps creates a professional-client relationship of any kind.

If you are facing a crisis — abuse, addiction, infidelity, a mental-health emergency, self-harm, or thoughts of suicide — please contact a qualified professional or emergency service right away. In the U.S., call or text 988 (Suicide & Crisis Lifeline) or call 1-800-799-7233 (National Domestic Violence Hotline). These apps are for the ordinary middle of life, not an emergency.

Assumption of risk

You use the apps voluntarily and at your own risk. You are responsible for your own decisions and actions, and for any conversations, exercises, or steps you choose to undertake based on the content. Outcomes depend on many factors outside our control, and we make no guarantee of any particular result for your marriage, family, finances, work, or wellbeing.

Disclaimer of warranties

To the fullest extent permitted by law, the apps and everything in them are provided “as is” and “as available,” without warranties of any kind, express or implied — including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise the apps will be uninterrupted, error-free, or that every piece of content will be accurate or complete. We work hard on reliability, but we can't warrant it.

Limitation of liability

To the fullest extent permitted by law, By The Way and its founder will not be liable for any indirect, incidental, special, consequential, or punitive damages, for any loss of data, goodwill, or profits, or for any other loss arising out of your use of — or inability to use — the apps. In every case, to the fullest extent permitted by law, our total liability for all claims together will not exceed the amount you paid us in the twelve months before the claim. Some places do not allow certain limitations, so parts of this section may not apply to you.

By creating an account and accepting these Terms, you acknowledge and agree to this section and the two sections above it.

Indemnification

If your violation of these Terms, your misuse of the apps, or your violation of someone else's rights results in a third-party claim against By The Way or its founder, you agree to cover the reasonable costs and damages that flow from it. This doesn't apply to claims caused by our own breach of these Terms, and it doesn't limit any rights consumer-protection law gives you.

Ending the relationship

You can stop using the apps at any time, and you can delete your account yourself from account settings in any app — deletion removes your account and its data. Two things to know before you do: if you have a paid subscription, cancel it first (deleting the account does not cancel billing on its own), and in couple-based apps, the partner who created the couple account also removes the shared couple data when they delete. If you'd rather have a human handle it, write hello@bytheway.biz and we'll process the deletion within seven days.

We may suspend or terminate your access if you materially violate these Terms, if the law requires it, or if we discontinue a service — in which case we'll give you reasonable notice and a chance to keep your content wherever we can.

Changes to these terms

We may update these Terms as the service grows. If a change is material, we'll notify you — by email or inside the apps — and ask you to accept the new version before it applies to you. For non-material changes (clarifications, renamed features, typos), the update takes effect when it's posted, and continuing to use the apps means you accept those. The version number and effective date at the top of this page will always tell you which terms you're on.

Governing law

These Terms, and any dispute arising out of them or your use of the apps, are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. Any dispute that ends up in court will be heard in the state or federal courts located in Georgia, and you and we both consent to their jurisdiction. If the law where you live gives you consumer rights that can't be waived, those rights stay yours.

Severability and the whole agreement

If any part of these Terms turns out to be unenforceable, the rest stays in force, and the unenforceable part is replaced by the closest enforceable version of its intent. These Terms, together with our privacy policy, are the whole agreement between you and us about the apps. If we don't enforce a provision right away, we haven't waived it.
